Mayor Tucci reported that in accordance with N.J.S.A. 10:4-6 adequate notice of this meeting of the Mayor and Council has been provided.

REPORTS OF STANDING COMMITTEES:
The Mayor stated that the Board of Chosen Freeholders recognized the Borough of West Long Branch at their July 8th meeting on the successful completion of the Franklin Lake Lighting Project. A sign reflecting the use of County Open Space funds for this project will be displayed at the Lake.
The Mayor reported that the Freeholders also adopted a resolution approving plans and specifications for improvements to the intersection of Cedar Avenue and Norwood Avenue at the same meeting.
The Mayor made reference to a July 1st letter from the Monmouth County Prosecutor’s office in response to a complaint filed by Councilman Hegarty that the Public Works Department cleaned the Old First Methodist Church Cemetery to assist with an Eagle Scout project. The letter states that the Prosecutor’s office has concluded its investigation of the matter and found that it is not criminal in nature. Therefore, they have closed the file and there will be no charges.
Councilman Neyhart reported that the basketball team from OMAGH Ireland came to the United States for an eleven day stay. While they were here, they came to the Jersey Shore for a game against the Mid-Monmouth Boys

Basketball Team at the Monmouth University MAC. Councilman Neyhart had the honor of attending the game and accepting an emblem from the team on behalf of the Borough.
Councilman Neyhart read the following report:
Traffic Enforcement Issues
In the period from May 1, 2010 to August 4, 2010, the West Long Branch Police Department conducted various traffic enforcement details:
• 730 Motor Vehicle Stops throughout the Borough during that time.
o 58 in the Parker Road vicinity (including side streets).
o 8 on Delaware Avenue.
• 73 Radar Enforcement details were conducted throughout the Borough.
o 17 on Delaware Avenue which resulted in 8 speeding summonses.
o 11 on Parker Road which resulted in 20 speeding summonses.
Increases in Police Calls – Year to Date, 2010 vs. 2009
o 32 more Motor Vehicle Accidents
o 39 more Suspicious Persons Investigations
o 50 more Suspicious Vehicle Investigations
o 31 more Business Alarms Investigated
In the period from May 1, 2010 to August 4, 2010, the West Long Branch Police experienced a surge in criminal activity, often times resulting in arrests:
o 14 Burglaries to homes & automobiles (2 persons arrested and responsible for several burglaries).
o 2 Gas Station Robberies* (1 person arrested in connection with both)
o 58 Arrests, including:
6 Drug Related Offenses
4 Assaults
7 Drunk Drivers
29 Contempt of Court Arrests (time consuming arrests often involving prisoner transportation to other facilities including Jails located throughout the State)
Councilman Neyhart reported that he and Councilmembers Hegarty and Villa met with the Police Chief, Police Captain, and Traffic Safety Officer to discuss different ideas to address the concerns from the residents on Delaware and Maryland Avenues. More calculations need to be done on those streets. They also discussed the problem of Shore Regional High School students parking on the residential streets in the vicinity of Franklin Lake to avoid parking on the school’s property. As a result, it is recommended that the Council consider limiting parking to two hours during the school season between the hours of 7:00 AM and 5:00 PM from Monday through Friday on the following streets: Lakeview Avenue, Franklin Parkway, Throckmorton Avenue, East Lakeview Avenue, and a portion of Halsey Street. These parking limitations will begin on a temporary basis when school starts. Councilman DeBruin noted that the students who park on the school property have to consent to a search of their vehicle and are subject to random drug testing.

Councilman Cioffi read the following report:
Environmental Commission:
Several complaints were received in regards to the geese situation at Franklin Park Lake. The company that was contracted to monitor the situation has provided biweekly status reports to the Commission and is currently addressing the issues at the Lake and various parks. As mentioned at the last meeting, the molting season of these birds (which prevents them from flying) created issues at the Lake and other locations, but since has ended and the border collie has started to work to harass these birds.
The Commission is actively looking over various plans that they are provided by the Planning and Zoning Boards. The Commission has set up a new type review system to expedite their suggestions and requirements to the applicant prior to his/her building. Both Boards have been slow in the past few months.
With the recent expenditure of money to refurbish Franklin Park Lake, the Commission has taken on the task of water testing to monitor certain waterways in the Borough to prevent possible hazardous materials from being drained into our waters. There will be no cost to the Borough for this testing.
The Commission will host their recycling event on October 2nd. The hours will be from 1pm-3pm at the West Long Branch Community Center. This event will focus on electronics, books and clothing. In the past, electronics were the hot item, along with shredding, and since it will be the same day of the town-wide garage sale, the hours will be adjusted to the afternoon to allow residents to take advantage of our event. More information will follow.
Recreation Commission:
Summer concert series is continuing and even with record-breaking temperatures, these concerts have been a success. The next concert is set for this Friday at 7PM at the Lake. Special thanks to the Recreation Commission members that are hosting this, DPW for all that they do to assist and the Police Department for security and traffic control.
The Mayor acknowledged that there has been a problem with one of the Franklin Lake aerators. The contractor is actively working on correcting the problem. Also, she confirmed that the Lake has been restocked with fish.
Councilman DeBruin suggested that the West Long Branch Environmental Commission contact New York to obtain information on the process they are using for geese control.

The Borough Administrator reported that he received a notice on behalf of New Jersey American Water Company petitioning the BPU for a 13.9% increase in their rates. There will be public hearings with respect to this petition over the next several weeks. He recommended that the Borough send a letter of opposition to this increase.

The Borough Clerk made reference to the following letter, dated July 29th, from Monmouth University:
Dear Ms. Cole:
I am writing on behalf of Monmouth University to request an approval to place a horizontal banner across Norwood Avenue from our campus. We would like to temporarily attach the banner to utility poles from September 1st through September 20th of this year and are in the process of receiving approval from Jersey Central Power & Light (JCP&L).
The banner is 3 feet by 30 feet long and will read “WELCOME BACK, STUDENTS!”. The banner would be placed on Norwood Avenue at the cross street of Kirby Avenue. I have provided the Letter of Indemnification from JCP&L for your signature as well as an illustration of the banner for your reference.
As Norwood Avenue includes portions of County and State owned roads, I have also contacted the County of Monmouth Traffic Engineer as well as the State Department of Transportation. We are in the process of seeking the necessary approvals from both government entities.

WHEREAS, the Borough Council further recognizes that it is incumbent upon not only public officials but upon the entire community to take action to prevent such abuses in our community; and
WHEREAS, the Borough Council has applied for funding to the Governor’s Council on Alcoholism and Drug Abuse through the County of Monmouth;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of West Long Branch, County of Monmouth, State of New Jersey, as follows:

WHEREAS, the Tax Collector has informed the Mayor and Borough Council that the Monmouth County Board of Taxation was delayed in forwarding the necessary information for the preparation and mailing of final tax bills to the real estate taxpayers of the Borough of West Long Branch for the year 2010; and
WHEREAS, the present statute requires the imposition of a late charge if third quarter 2010 taxes are not paid by the 10th of August; and
WHEREAS, it would be unfair and unreasonable to impose a penalty for a delinquent payment when the amount of the payment is unknown;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of West Long Branch that the West Long Branch Tax Collector is hereby ordered and directed, according to Public Law 1994, Chapter 72, signed July 14, 1994, that if tax bills are not delivered or mailed at least twenty-five (25) calendar days prior to the standard due date, then the delinquency date for third quarter 2010 taxes shall be established as the twenty-fifth (25th) calendar day after the date the tax bill was delivered or mailed; and
BE IT FURTHER RESOLVED that the tax bills will contain the date on which interest shall start accruing.

RESOLUTION AUTHORIZING CLOSURE OF
DELAWARE AVENUE ON AUGUST 14, 2010

WHEREAS, the Governing Body has received a request on behalf of the residents of Delaware Avenue to close that street off, between Virginia Terrace and Maryland Avenue, on August 14, 2010, with a rain date of August 15th, to hold a neighborhood block party; and
WHEREAS, the request has been submitted to the West Long Branch Police Chief, who has approved the same provided that someone be available during the block party to move the barriers in the event of an emergency and that the roadway not be completely impassable so as to allow emergency vehicles (police cars, fire trucks, and ambulances) access, if necessary;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of West Long Branch that the section of Delaware Avenue running between its intersections with Virginia Terrace and Maryland Avenue shall be closed to vehicular traffic on August 14, 2010, with a rain date of August 15th, from 2:00 PM until 9:00 PM, and barriers shall be placed at the Virginia Terrace and Maryland Avenue ends of the area being closed off, which shall be done under the supervision, and with the approval, of the West Long Branch Police Department; and
BE IT FURTHER RESOLVED that detour signs, if necessary, must be installed in accordance with the directions of the West Long Branch Police Department; and

WHEREAS, the Borough of West Long Branch is a member of the Monmouth Municipal Joint Insurance Fund; and
WHEREAS, said renewed membership terminates as of December 31, 2010, unless earlier renewed by agreement between the Borough and the Fund; and
WHEREAS, the Borough of West Long Branch desires to renew said membership;

1. The Borough of West Long Branch agrees to renew its membership in the Monmouth Municipal Joint Insurance Fund and to be subject to the Bylaws, Rules and Regulations, coverages, and operating procedures thereof as presently existing or as modified from time to time by lawful act of the Fund.
2. The Mayor and Borough Clerk shall be and hereby are authorized to execute the agreement to renew membership annexed hereto and made a part hereof and to deliver same to the Monmouth Municipal Joint Insurance Fund evidencing the Municipality’s intention to renew its membership.

Councilmember DEBRUIN offered the following resolution and moved its adoption:
RESOLUTION AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION
(#00401) AND EXECUTION OF A GRANT AGREEMENT WITH THE
NEW JERSEY DEPARTMENT OF TRANSPORTATION FOR THE
REHABILITATION OF PINEWOOD AVENUE
(R-10-113)
WHEREAS, Pinewood Avenue is a main collector roadway that runs north/south between Wall Street (County Route 32) and Cedar Avenue (Route 71) and provides direct access for area residents to these two major collector roads; and
WHEREAS, Pinewood Avenue also provides direct access to the Monmouth University Campus, which abuts the east side of Pinewood Avenue along the project limits; and
WHEREAS Pinewood Avenue also serves as an alternate route for residents of West Long Branch and adjacent municipalities, to avoid Route 71 traffic congestion; and
WHEREAS, the condition of the existing roadway pavement and sidewalk along the entire length of Pinewood Avenue is in poor condition consisting of cracked or missing sidewalks, alligator type cracking and large potholes in the pavement area which poses a safety hazard for vehicular and pedestrian traffic; and
WHEREAS, the Borough of West Long Branch proposes to reconstruct Pinewood Avenue between Hollywood Avenue and Cedar Avenue, a distance of approximately 1,400 feet. The improvements include the installation of new concrete curb and sidewalk, drainage improvements and a total reconstruction of the existing roadway; and
WHEREAS, the Borough Engineer submitted a not-to-exceed amount of $2,500 to prepare and submit said application;
NOW, THEREFORE, BE IT RESOLVED that the Borough Council of the Borough of West Long Branch, formally approves the grant application for the above state project; and
BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby authorized to submit an electronic grant application identified as MA-2011-West

Long Branch Borough-00401 to the New Jersey Department of Transportation on behalf of the Borough of West Long Branch; and
BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby authorized to sign the grant agreement on behalf of the Borough of West Long Branch and that their signatures constitute acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement; and
BE IT FURTHER RESOLVED that the Borough Engineer’s quote of an amount not-to-exceed $2,500 for the preparation and submission of said application is hereby accepted.

WHEREAS, Ordinance No. O-08-26, which fixes the salaries of various municipal officers, employees and appointees, has been adopted following public hearing; and
WHEREAS, said ordinance provides for salary ranges in the case of various job titles and positions; and
WHEREAS, it is the intention of the Governing Body to fix the salaries of those individuals who hold such positions;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of West Long Branch that the salaries of the officers and employees holding the positions set forth below, and subject to the salary ranges set forth in the aforementioned ordinance, are hereby fixed for calendar year 2010 as follows:

WHEREAS, it is the recommendation of the Council Liaison to the Environmental and Shade Tree Commissions to hire CANDACE BRASCH MITCHELL to fill these positions; and
WHEREAS, it is recommended that she be hired at a salary of $900 per year for the Secretary to the Environmental Commission and $450 per year for the Secretary to the Shade Tree Commission;

WHEREAS, AVALON BAY COMMUNITIES, INC. made application to the West Long Branch Planning Board in connection with improvements on Lot 28 in Block 70 and paid the required application and escrow fees;
WHEREAS, the application has been heard and approved by the Planning Board, and the applicant has requested a refund of the outstanding engineering escrow fees in connection with the Planning Board application; and
WHEREAS, the Chief Financial Officer reported that there is a balance of $1,028.34 in the escrow account for AVALON AT WEST LONG BRANCH; and
WHEREAS, the Borough Engineer reported by letter dated July 23rd that he has no objection to the refund of the outstanding balance;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of West Long Branch that the sum of $1,028.34, which represents the balance in the AVALON AT WEST LONG BRANCH escrow account in connection with its Planning Board application, plus any accrued interest be refunded to the applicant; and

WHEREAS, the Borough Engineer has reported that the Weston Subdivision is entirely complete; and
WHEREAS, the Chief Financial Officer has reported that the Borough is still holding engineering escrow fees, in the amount of $45.40, and performance escrow fees, in the amount of $22,400.69, in connection with this matter; and

WHEREAS, the Borough Engineer has stated by letter dated June 30th to Adam Robinovitz, the original developer of this project, that the Borough can release these fees contingent upon his written authorization that the Borough can deduct unpaid charges in the amount of $614.00 in connection with this project from the fees being held; and
WHEREAS, Mr. Robinovitz provided written authorization, dated July 16th, to deduct the unpaid charges from the performance escrow fees and said invoice has been paid;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of West Long Branch that the sum of $45.40, which represents the balance in the engineering escrow account, and $22,400.69, which represents the balance in the performance escrow account, in connection with the Weston Subdivision, plus any accrued interest, be refunded to Adam Robinovitz, P.O. Councilman Cioffi reported that he recently learned of information on a program/policy that he recommends instituting in the Borough’s parks and playgrounds. The Borough would need to adopt a resolution establishing a policy to designate all Borough parks and playgrounds as “Pesticide Free Zones”. Further, the policy would place limits on fertilizer phosphorous content. These measures are important steps in reducing non-point source pollution to waterways and protecting public health. There are currently seven municipalities in Monmouth County with such a policy. Councilman Cioffi stated that he will have additional information for consideration by the Mayor and Council at the next meeting.

PUBLIC HEARING:
Maryann Serenelli, 142 Parker Road, expressed concerned about speeding on her street and requested the installation of speed humps to resolve the problem. Councilman Neyhart responded that there is too much traffic volume on Parker Road to use speed humps.
The Mayor assured her and the rest of the audience that even though the Police Department is very busy they are addressing the problem of speeding.

Further, she noted that speed bumps have not always worked. However, she acknowledged that there are now portable speed humps which can be investigated for use in certain areas.
Councilman Neyhart stated that “Watch Children” signs have been posted on Delaware and Maryland Avenues and the Police Department will be using the traffic counters again before and after school opens.
The Mayor agreed that it is a good idea for the West Long Branch Police Department to work in conjunction with the Eatontown Police Department to address the speeding complaints on Parker Road. Councilman Neyhart confirmed that the Class II Special Police Officers will be used to assist with traffic enforcement.
Ms. Serenelli complained that the car dealerships along Highway 36 direct people down Parker Road for test drives. Councilman Cioffi told her to call the Police Department when she sees that happening.
Kerry Bray, 50 Delaware Avenue, asked when the committee met to discuss the traffic issues and when they will meet again. Councilman Neyhart replied that there is no set schedule. He confirmed that they met Thursday or Friday of last week and will meet again after the traffic counts are available. Mrs. Bray wanted to know exactly where the traffic issues on Delaware and Maryland Avenues stand. Councilman Neyhart confirmed that the signs are in place and the Police Department will run radar.
Honey Ornstein, 11 Maryland Avenue, commented on the following items:
• “Watch Children” signs have been on Maryland Avenue for twenty-five years.
• She complained that people can’t park at Franklin Lake because Shore Regional High School students park their cars there instead of in the school parking lot.
• In connection with Councilman Cioffi’s earlier comments concerning “Pesticide Free Zones”, she stated that both Shore Regional High School and Frank Antonides School use pesticides. Councilman Cioffi replied that they have regulations for the use of pesticides.
• She complained that you can’t see the Lake because of the overgrowth. Councilman DeBruin responded that it is his understanding that anything that is indigenous to the Lake can’t be removed. However, the Borough is permitted to remove anything that wouldn’t naturally grow there.
Barbara Marchese, 135 Parker Road, asked when the arrests were made that were referred to in the report Councilman Neyhart read this evening. Captain Mihlon, who was in the audience, confirmed that the Maple Avenue burglary was concluded a couple of weeks ago. Ms. Marchese mentioned that there was an attempted burglary at her home and wondered why the residents weren’t notified that burglaries were a problem. She was assured that it was in the newspaper and it was mentioned at several Council meetings. The Captain offered to speak to Ms. Marchese privately after the meeting.
Harriet Popok, Woods Road, asked if the burglaries are confined to a particular area in town. The Captain informed her that they are not.
Dan Speck, 58 Delaware Avenue, stated that he thought the Police Chief had ordered the signs to restrict turning onto Delaware and Maryland Avenues to certain hours. He was informed that those signs were not ordered.
Councilman DeBruin commented that there has been some concern with those types of turns because it will affect the residents who live in those neighborhoods.

Jack Kearns, The LINK News, stated that all of the towns are experiencing similar situations.
David Ornstein, 11 Maryland Avenue, asked why the aerator is not working at Franklin Lake. He was informed that the problem is being investigated. Also, he requested that the street light in front of his home be upgraded to provide more light. The Borough Clerk was directed to contact JCP&L to request the street light be upgraded.
The Captain encouraged everyone to register on Nixle.com to receive important messages from the Police Department. He also advised that the Police Department now has an anonymous tip line which is (732) 403-3500.
Linda Bosniak, 1 South Arlene Drive, asked if the traffic speed boxes are worthwhile. The Police Captain thinks they are beneficial. She requested that they be used more often.
There being no one else wishing to speak, on motion made by Councilman Neyhart, seconded by Councilman DeBruin, and carried unanimously, the meeting was adjourned at 9:12 PM.
